The 17-year-old Fairland High School student accused of rape waived his preliminary hearing this week and is expected to enter a plea next month.
Charles Cassinelli was charged in September with second-degree rape after allegedly having sex with a consenting juvenile girl in an abandoned garage.
Although Cassinelli and the victim both told authorities that the sexual encounter was consensual, the girl is not 16 - the age of consent in Oklahoma.
Cassinelli's attorney, Ron Stockwell, requested that his client be treated as a youthful offender at the recommendation of Dr. Curtis Grundy, with the Oklahoma Office of Juvenile Affairs.
A request was also made that a report, detailing the defendant's health and history, be sealed.
Ottawa County Associate Judge Robert Reavis honored Stockwell's requests.
If convicted as a youthful offender, Cassinelli would be placed in OJA custody until he turns 19, at which point he would be placed on probation for 10 years.
Prosecutor Ben Loring said he was unable to comment on the case because it has been sealed.
Cassinelli is free on a $40,000 bail and was ordered to have no contact with the alleged victim. He is expected to return to court on Feb. 20.
